A Divorce or Dissolution of Marriage dissolves the marriage of the spouses and remedies disputes between the spouses. The types of disputes between the parties typically involve child custody, visitation, child support, spousal support, asset and debt division, former name restoration, and even restraining orders. The entire process is paperwork intensive but also requires court hearings (which lawyers would refer to as “Motion Work”) with possibility of formal trial and live witness testimony. The parties typically have to obtain a QDRO (Qualified Domestic Relations Order) to release and divide the retirement. Attorney David L. Requirements for Dissolution of California Residences:

You MUST meet California’s residency requirements. Either you or your spouse must have lived in:

  • California for the last 6 months, AND
  • The county where you plan to file the divorce for the last 3 months.

Requirements for Dissolution of Domestic Partnerships in California:

If your domestic partnership is registered in California, you have automatically agreed to the jurisdiction of the California courts to end your domestic partnerships — even if you move away or have never lived in California. So you do NOT need to meet the residency requirements that married couples must meet.

If your domestic partnership was NOT registered in California, you or your domestic partner must have lived in:

  • California for the last 6 months, AND
  • The county where you plan to file the divorce for the last 3 months.
